IsItPatented.ai provides AI-powered patent novelty analysis. Users submit invention descriptions in plain English, and the Service returns an automated analysis including a novelty score, prior art matches, and an action plan. The Service searches publicly available patent records from the United States Patent and Trademark Office (USPTO).

3. Not Legal Advice

The Service is an educational and informational tool only. IsItPatented.ai is not a law firm and does not provide legal advice. No attorney-client relationship is created by using this Service. Results are probabilistic estimates generated by artificial intelligence and should not be relied upon as a substitute for professional legal counsel. Always consult a registered patent attorney or agent before making filing decisions.

4. User Conduct

You agree not to:

Use the Service for any unlawful purpose; attempt to reverse-engineer, decompile, or extract the underlying AI models; submit queries designed to overload or disrupt the Service; use automated tools to scrape results at scale without authorization; or misrepresent AI-generated results as professional legal opinions.

5. Intellectual Property

You retain full ownership of any invention ideas you submit to the Service. We do not claim any intellectual property rights over your submissions. The Service interface, branding, AI models, and all generated report formatting are the intellectual property of IsItPatented.ai.

6. Data Handling

Invention descriptions submitted to the Service are processed by our AI system to generate results. We do not permanently store your invention descriptions after analysis is complete. For more information, see our Privacy Policy.

7. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. IsItPatented.ai shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, damages for lost profits, lost data, loss of business opportunity, or failure to file a patent application in a timely manner.

The Service may contain links to third-party websites and services, including patent filing platforms and professional service providers. IsItPatented.ai is not responsible for the content, policies, or practices of any third-party service. Your interactions with these services are governed by their own terms.

9. Termination

We reserve the right to suspend or terminate access to the Service at any time, for any reason, without prior notice. Upon termination, all rights granted to you under these terms will immediately cease.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of the State of Delaware.
